CookIt Terms of Use

These Terms of Use govern your use of the CookIt mobile application (the “Service”), published by The Krux (“we”, “us”, or the “Publisher”). By downloading, installing, or using CookIt, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

• Application / CookIt: the CookIt software for mobile devices, including all updates and new versions.
• Application Store: the Apple App Store, Google Play, or any other distribution channel through which CookIt is made available.
• Publisher / we / us: The Krux, the entity that publishes and maintains CookIt. Contact: cookit.app.contact@gmail.com.
• Device: any phone, tablet, or other electronic device on which the Application can be installed.
• Service: the Application and all features provided through it.
• Subscription: a recurring, paid offer that unlocks the Premium features of CookIt.
• You: the individual who downloads, installs, or uses the Service.

2. Acknowledgment

You must be at least 13 years old to use CookIt. By using the Service you represent that you meet this requirement and that you have read and accepted these Terms and the Privacy Policy.

3. Subscriptions

CookIt is free to download and use for its core features. Some features are gated behind an optional Premium Subscription.

• Billing. All Subscriptions are sold and billed exclusively through the Application Store (Apple App Store or Google Play). We never see or process your payment information.
• Renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before the period ends.
• Cancellation. You can cancel your Subscription at any time through the subscription settings of your Application Store account. Cancellation takes effect at the end of the current billing period.
• Refunds. Subscription fees are non-refundable except where required by applicable law. Refund requests are handled by the Application Store, not by us.
• Price Changes. We may change Subscription prices. Any change will be communicated in advance through the App or the Application Store. Continued use of the Subscription after the change takes effect means you accept the new price.

4. Intellectual Property

The Service, including its source code, design, graphics, logos, icons, and content provided by us, is the exclusive property of the Publisher and is protected by intellectual property laws.

The recipes, photos, and other content you create or import remain your property. By using the share feature, you confirm that you have the right to share that content.

5. Your Feedback

If you send us suggestions, ideas, or feedback about CookIt, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to use that feedback to improve the Service, with no obligation to compensate you.

6. Acceptable Use

You agree not to:

• Use CookIt in violation of any applicable law;
• Attempt to reverse engineer, decompile, or extract the source code of the Application except where this right cannot lawfully be excluded;
• Bypass, disable, or compromise any security or licensing mechanism of the Application;
• Use the Service to distribute illegal, infringing, or harmful content.

7. Links to Other Services

CookIt may contain links to third-party websites or services (for example, when you share a recipe through another app). We are not responsible for the content, privacy practices, or terms of these third parties. You access them at your own risk.

8. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you breach these Terms or if continued operation of the Service becomes impractical. Upon termination, your right to use the Service ceases immediately. You can stop using CookIt at any time by uninstalling the Application.

9. “AS IS” and “AS AVAILABLE” Disclaimer

CookIt is provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be error-free, uninterrupted, secure, free of viruses, compatible with every Device, or that any data you store in the Application will be preserved. You are responsible for keeping your own backups.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Publisher’s total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the total amount you actually paid for the Service in the twelve (12) months preceding the claim, or (b) 100 euros.

In no event shall the Publisher be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or loss of goodwill, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, the limitations above apply only to the extent permitted by law.

11. Governing Law

These Terms are governed by French law. If you are a consumer residing in the European Union, you continue to benefit from the mandatory protections of the law of your country of residence.

12. Disputes

If you have a dispute with us, please first contact us at cookit.app.contact@gmail.com so that we can try to resolve it informally. If we cannot resolve the dispute informally, the courts of France will have jurisdiction, subject to applicable consumer protection law.

13. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms is not a waiver of that right.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Material changes will be communicated through the Application or the Application Store at least 30 days before they take effect. Continued use of CookIt after the effective date of the new Terms means you accept them.
